1. Information about the seller

2. Definitions
In these General Terms and Conditions the following terms have the following meanings:
'Farmaxx': Idealpharma BVBA , company with registered office in Belgium, 2660 Antwerp, Heidestraat 1, registered in the Crossroads Bank for Enterprises with company number 0864.605.936 and VAT number BE 0864.605.936, with telephone number 03/827.47.57
'Buyer': any consumer or company that enters into a contractual relationship with Farmaxx to which these general terms and conditions apply.
Agreement: The distance agreement concluded between the Company and the Buyer for the purchase of Products via the Website. The Agreement is governed by these general terms and conditions.
Business Day: Every day, except Saturday, Sunday and public holidays

Products: All products available for purchase on the Website.
'Medical products': Non-prescription medicines and parapharmaceutical products.
'Durable medium': any tool that enables the consumer or the trader to store information addressed to him personally in a way that makes this information accessible for future use during a period that is adapted to the purpose for which the information is intended, and which allows an unaltered representation of the stored information;
3. Scope of the General Terms and Conditions
3.1 These general conditions apply to every offer of the products on the website Farmaxx and all Contracts via the Website between the buyer and Farmaxx.
3.2 These General Terms and Conditions define the respective obligations of the Contracting Parties in the purchase- sale of Medical Products through the online shop, accessible on the Website in accordance with the ordering process described in these General Terms and Conditions.
3.3 These general terms and conditions will be made available to the Buyer , at least before the conclusion of the Agreement, in a manner that will enable the Buyer to store the general terms and conditions on a durable electronic data carrier.
4. Products and Offer
4.1 Farmaxx takes the utmost care in posting information about the properties of the medical products online, including the technical descriptions based on data from its partners and suppliers, and with photographs illustrating the medical products, all this to the extent the technical means allow it and according to the best standards on the market.
Certain characteristics of a product, such as color, size, weight, packaging and others, may differ from the photos on delivery, as shown on the website. Photos are therefore not binding.
4.2 For security reasons, Farmaxx does not sell the following drugs through the Site:
a) Medicines for which no authorization has been obtained for the Belgian market in accordance with article 6§1e of the Law of 25 March 1964 on medicinal products;
b) Medicines for which a medical prescription is required in Belgium.
It is indeed possible for consumers to make reservations for certain products which requires a prescription, to be prepared for pick up at a physical pharmacy of your choice (Pick up by the consumer).
In those cases, the actual sale is concluded between the consumer and his pharmacy of choice. Farmaxx itself does not conclude any sales but only occurs here merely to facilitate the sale between the two parties.
5. Prices
5.1 All prices of the Products are expressed in euros and include VAT.
5.2 All prices of the products that offered on the site do not include the delivery costs. The delivery will be visible for the buyer at the time the order is placed (during the purchase process) , and will depend on the place where the products must be sent.
5.3 Rate reductions or other promotional offers indicated on the packaging of the ordered products have already been included in the sales prices stated on the Website.
5.4 The prices of the Products are the prices stated on the Website at the time the Buyer places an order.
5.5 The offers and the prices of the Products are only valid on the date on which the order is placed. Farmaxx reserves the right to change prices and offers at any time on the Web site . They can be changed on the Website at any time without prior notice.
5.6 Special offers are only valid while stocks last.
5.7 The prices stated at the end of the ordering process indicate the total prices, including all taxes, as well as the delivery costs and any other costs.
5.8 If Farmaxx ,after an order has been placed, finds that a product was not priced correctly on the Web site, Farmaxx will within short term contact the Buyer in writing.
In that case, the Buyer has the option to (1) continue to purchase the Products or (2) cancel the order. The Buyer must make his decision known within 14 days from the moment Farmaxx has notified the Buyer . This can be done by e- mail by sending an e-mail to info@farmaxx.be or via the Buyer's account on the Website.
After receiving confirmation that the Products have left Farmaxx , the Buyer can no longer cancel the order. In that case , the Products will be delivered and the Buyer can return the Product according to the procedure described in the return conditions.
After cancellation of the order, the Buyer will receive confirmation of the cancellation by sending an email to the email address provided by the Buyer and Farmaxx will refund the amounts already paid to the credit or debit card used by the Buyer to pay.
5.9 The order will not be processed until Farmaxx has received the Buyer's instructions.
If Farmaxx is unable to contact the Buyer , using the contact details provided by the Buyer during the ordering process, or if Farmaxx does not receive a response from the Buyer within the above-mentioned timeframe, Farmaxx will treat the order as canceled and it will notify the Buyer thereof in writing.
6. Payment
6.1 The Buyer can pay for the Products through the following payment methods:
- By bank transfer to the number [bank account] (bic: [BIC])
- Through the website using an internationally accepted valid credit card, debit card
- On the website via PayPal
- On the website via Mollie
Payment via cryptocurrencies is not possible for legal reasons.
6.2 Security measures via SSL are proposed to ensure that the online payment can be made safely.
If a payment method with a credit card is chosen, the terms and conditions of the relevant card issuer apply. Farmaxx is not a party to the relationship between the Buyer and the card issuer.
6.3 To ensure the security of your online transactions, Farmaxx works with recognized payment partners and credit card issuers. Payments are processed through the secure system of Docdata Payments , the following (credit) cards are accepted: Visa, Mastercard, Mister Cash / Bancontact, Maestro. Online payment is thus carried out via a closed security system, with which your bank details are always encrypted when sent over the internet. Loss or theft of your identity or credit card data is thus reduced to a minimum. Farmaxx believes it has taken all possible and relevant precautions and thus acts as a normal, forward-looking and careful online intermediary. Possible identity theft or financial theft cannot therefore be invoked against Farmaxx.
6.4 The Buyer must pay at the time of placing the order.
6.5 A complaint from the Buyer does not in any way result in a suspension of his payment obligation.
7. Conclusion of agreements
7.1 Each order placed on the Website follows different steps: each step is completed consecutively by the “click” of a confirmation icon.
The purchase process follows a logical and transparent path that the Buyer can see thanks to a layout and graphic design provided for this purpose.
7.2 Farmaxx and the Buyer explicitly agree that a valid agreement can be concluded by using electronic forms of communication.
In particular, the lack of a digital or electronic qualified signature does not affect the binding force of the offer and its acceptance.
The electronic files of Farmaxx apply here, insofar as the law allows, as a presumption of evidence. Information, images, oral communications, statements, etc. with regard to all offers and the most important characteristics of the medical products that are provided by telephone or e-mail are displayed or made as accurately as possible.
When the Buyer clicks on an icon whose designation or presentation implies a commitment that any internet user can understand, he / she may be bound by a click. This is the case, for example, for the icons with the name “Validation”, “Payment” or similar names.
7.3 By clicking on the “Pay” button, the Buyer places a firm order of the items in the Buyer's shopping cart.
7.4 The confirmation of receipt of the order is made immediately upon receipt of the order. This confirmation of receipt of the order does not constitute a binding acceptance of the order.
7.5 Farmaxx reserves the right not to validate the order, in particular in the following situations:
- In case the ordered Products are not in stock. Farmaxx only provides the products that are in stock via the website. The services and prices apply as long as they are visible on the Site. In the event of an order for a Good that, for whatever reason, is no longer in stock, the Buyer will be informed about this and Farmaxx will cancel the order for the Good that is not in stock;
- In case of refusal of validation of the payment by the issuer of the payment card used by the Buyer, or in case of fraud or reasonable suspicion of fraud
- In case of an order for a large quantity of the same Product for the same delivery address
- In case of abuse of the right of withdrawal granted to the Buyer by article 9 of these terms and conditions for various previous orders
- When identifying a medicinal or therapeutic risk detected in the order of the ordered Goods (for example, in case of identification of an interaction between different products ordered, etc.).
In such a situation, the amounts deposited by the Buyer will be fully refunded as soon as possible, the order will be canceled and the purchase agreement will be considered as not having been concluded.
7.6 After validation of the order , Farmaxx sends a shipping confirmation of the order . This e-mail will be sent within two working days after Farmaxx has received the Buyer's order, unless the Buyer has chosen a payment method that does not involve immediate payment. In the latter case, the shipping confirmation will be sent at the latest two working days after receipt of the payment.
The purchase agreement is concluded by sending an e-mail by Farmaxx of a shipping confirmation of the order.
7.7 The Buyer undertakes to check whether he / she has received this e-mail confirming the dispatch of the order in his / her mailbox, if necessary also in the spam folder or junk folder.
The Buyer undertakes on the one hand to keep a copy of this email confirming the dispatch of the order and, on the other hand, a copy of the relevant General Terms and Conditions , either by printing them or by keeping them on a Durable medium.
Regardless of other written evidence or evidence stored on another Durable Data Medium to which the Buyer has access, it is agreed that the automated registers, stored in the automated systems or those of Farmaxx 's hosting service , may serve as evidence for the communication, the content of the orders, their date and the payments made between the Contracting Parties.
7.8 The shipping confirmation also includes an invoice.
The buyer agrees to receive an electronic invoice and declines to require a paper copy.
8. Delivery
8.1 Farmaxx undertakes to deliver the Products within a specified period, which starts after full receipt of payment. This delivery period , which will not be longer than 30 days, depends on the available stocks and is indicated by the Seller during the purchase process . By placing the order, the Buyer agrees to the indicated Delivery Period.
8.2 The delivery times are the working days as stated on the Website when ordering.
Farmaxx does everything within its power to respect the stated delivery times. If Farmaxx is unable to deliver the Products within the stated term, Farmaxx undertakes to notify the Buyer of this in writing. The Buyer will then give Farmaxx a new, reasonable delivery period. If Farmaxx again exceeds the deadline, the Buyer has the right to cancel the order.
8.3 The Products ordered are delivered in a package, by post, possibly through the intervention of a transport company engaged by Farmaxx at the delivery location indicated by the Buyer to Farmaxx during the purchase process.
8.4 If no one is available at the Buyer's address at the time of delivery, Buyer must follow the instructions of the delivery service in charge of delivery of the order.
8.5 Farmaxx reserves the right to make partial deliveries of the ordered Products, for example if part of the order is delayed or unavailable. In case of partial delivery, Farmaxx will notify the Buyer.
8.6 Any risk of loss or damage to the products is transferred to the buyer on receipt of the Goods, ie at the time that the Buyer, or appointed by Purchaser third party other than the carrier, the Company takes physical possession.
Upon delivery / collection, the Buyer must check the packaging for possible damage. If the Products are damaged, the Buyer may not accept the delivery and must immediately notify Farmaxx . After notification, Farmaxx will provide the Buyer with the necessary instructions with regard to the damaged Products.
9. Right of withdrawal
9.1 The Buyer has the right to revoke his order, without giving reasons, within a period of fourteen (14) calendar days.
9.2 The starting point of the period to exercise the right of withdrawal can vary.
The following rules apply:
- If the delivery is a single Product, the period starts the day after receipt of the Product by the Buyer.
- If the delivery relates to several Products that are delivered on separate days, the period starts on the day after the Buyer has received the last ordered Product.
If the delivery relates to a Product over a certain period, the period starts on the day following the day on which the Buyer has received the first delivery of the Products.
9.3 If Farmaxx has not provided the Buyer with the legally required information regarding the Buyer's right of withdrawal, it will have twelve (12) months to withdraw from the Agreement from the day after the end of the aforementioned first fourteen (14) term. days. If Farmaxx has provided Buyer with the legally required information regarding Buyer's right of withdrawal within the aforementioned twelve (12) month period, Buyer has fourteen (14) days to withdraw from the Agreement from the day after Buyer has received the information from Farmaxx.
However, by accepting these terms and conditions, the Buyer acknowledges that it has taken note of the legally required information provided by Farmaxx regarding the Buyer's right of withdrawal.
9.4 The Buyer must notify Farmaxx of its withdrawal decision:
- Either through the Buyer's account on the Website,
- Either by clicking on a link specially provided for this purpose, which the buyer can find in the confirmation e-mail sent by Farmaxx to the buyer;
The Buyer can also use the model withdrawal form (attached to these General Terms and Conditions).
9.5 The Buyer must return the Products to Farmaxx without undue delay and in any case no later than fourteen days after sending the notice of withdrawal to Farmaxx . The Products must be shipped to Farmaxx in the same manner as the one in which the Buyer received the Products;
9.6 The Buyer receives the return label by email or has access to the return label via his personal profile on the Website. The return label must be affixed to the packaging of the Products that the Buyer wishes to return;
9.7 The shipping costs will be borne by Farmaxx if a problem arises during the processing and delivery of your order that can be attributed to Farmaxx , unless the Buyer has chosen a more expensive delivery method than the proposed standard delivery method. If this is not the case, the direct costs of the return will be borne by the Buyer.
Farmaxx reserves the right to postpone the refund until receipt of the returned Product.
9.8 In case of withdrawal:
- Farmaxx will refund the amounts already paid by the Buyer for the Products upon receipt of the Products. However, Farmaxx may reduce the refund to take into account any diminished value of the Products, if this was caused by the fact that the Buyer has handled them in a way that would not be permitted in a store.
- Farmaxx will make all refunds within a reasonable period of time after receipt of the Products.
- Farmaxx will reimburse the Buyer on the credit or debit card that the Buyer used to pay.
- Farmaxx has the right to reimburse the Buyer with vouchers if the Buyer has used vouchers to pay for the Products.
9.9 The order of the following Goods does not give the right of withdrawal:
- All medicines. Numerous medicines can spoil in the presence of heat or direct sun exposure. Since Farmaxx cannot check whether the medicines have been mishandled after delivery, they can therefore no longer be marketed. For this reason, no right of withdrawal is possible with regard to medicines;
- The Products whose seal has been broken or which have been damaged after delivery and which cannot be returned for hygienic reasons or with a view to health protection;
- Goods manufactured to the Buyer's specifications or clearly personalized;
- Goods that can spoil quickly or whose expiry date could be quickly exceeded.
Medical products that spoil quickly or with a limited shelf life and sealed goods that are not suitable to be returned for reasons of health protection or hygiene and of which the seal has been broken after delivery are excluded from the application of this right of withdrawal.
Examples include prescription-free medicines , para - pharmaceutical medical products and related medical products. Such medical products are therefore not eligible for return. The right of withdrawal only applies here if the goods have not yet been shipped, except in case of defect.
9.10 In the event that the right of withdrawal can be exercised, a return shipment must be sent with a carrier , in accordance with the return conditions that apply to the return conditions . The Customer receives the return label by e-mail or has access to the return label via his personal profile on the Website. The return label must be affixed to the packaging of the Products that the Customer wishes to return;
9.11 When the aforementioned enunciation has been valid and legally used correctly, Farmaxx will ensure repayment of the sum to the Buyer within fourteen (14) days by means of a chosen but internationally accepted method of payment.
10. Assignment and Subcontracting
10.1 Farmaxx has the right to transfer its rights and obligations under the Agreement to a supplier (eg for the delivery of the Product), but this will not affect the rights and obligations under these general terms and conditions.
10.2 If the Purchaser has purchased a Product as a gift, he may transfer the warranty as provided in clause 11 to the recipient of the gift without obtaining the consent of Farmaxx.
11. Guarantee
11.1 The Buyer is entitled to a legal warranty of two years. The legal warranty covers any defect or lack of conformity of the Products that manifests itself within a period of two years from the date of delivery of the Products.
11.2 The Buyer must notify Farmaxx by email of the defective Products to the address support@farmaxx.be or via the Buyer's account on the Website within a reasonable time after the defect is known or could reasonably have been known by the Buyer.
11.3 To return the Product , the Buyer must follow the procedure set out in the return conditions that apply to these terms and conditions . After return of the defective Product, Farmaxx will send the Buyer a new Product and we will bear all costs associated with the exchange of the Products.
11.4 If the good becomes defective within the first six months after delivery, it is assumed that the defect has existed since delivery. It is up to the seller to prove otherwise. If the defect is established more than six months after delivery, the consumer must prove that the good was not in conformity at the time of delivery.
11.5 The Product can only be replaced and supplied to the extent that it is still available or in stock from Farmaxx 's suppliers . If replacement is not possible or cannot be made within a reasonable period of time, the Buyer has the right to terminate the Agreement and Farmaxx will refund the price in accordance with clause 9 of the conditions under which the right of withdrawal can be exercised . 11.6 Some Products have a manufacturer's warranty. For details on the applicable terms and conditions, please refer to the manufacturer's warranty provided with the Products
11.7 As imposed by the applicable and relevant legal provisions, legally regulated quality controls apply to the medical products supplied by Farmaxx . The best before date is the date until which a parapharmaceutical or pharmaceutical product retains its specific properties, when properly stored. This expiry date is only valid as long as the packaging has not been opened and as long as the special storage conditions have been observed. The expiration date on these products is an indication of the manufacturer. During the specified period, the producer guarantees the quality of his product. This guarantee applies when the storage conditions stated on the label are also respected. The storage conditions on the label are therefore important. The expiry date is related to the special storage conditions. As a result, all links in the chain are responsible for quality; from the producer and all intermediaries (wholesalers, carriers, retailers) to consumers (during and after the purchase).
11.8 For business other than para-pharmaceutical and pharmaceutical products , which do not conform to the contract the buyer is asked Farmaxx as soon as possible to inform. Any compensation resulting from this can never be greater than the amount invoiced to the Buyer. 12. Complaints

12.3 The Buyer may also submit his complaint to the online dispute resolution platform provided by the European Union, http://ec.europa.eu/odr.
12.4 This clause does not affect the right of withdrawal and legal guarantees that the Buyer, if any, enjoys in accordance with these terms and conditions.
12.5 It is important that the Buyer checks upon receipt of the Products whether they are in conformity with your order and, if not, inform Farmaxx thereof within seven (7) working days. All notifications about a delivery that did not arrive on time must be reported by e-mail via info@Farmaxx.be.
12.6 The Buyer is not entitled to return medicines and / or medical aids (whether or not free of prescription). The Buyer is also not entitled to return other products for which there are no substantiated complaints. If the above is not followed up and goods are wrongly returned, then all costs associated with the return will be borne by the Buyer. In that case Farmaxx is free to stock the medical products with third parties at the expense and risk of the Buyer and / or to return these articles to the Buyer at the implicit or explicit request and expense of the Buyer.
12.7 Any returned medical products (other than medicines and / or medical devices) will only be accepted if they are in their original condition , namely in their packaging, unused, accessories, nutritional advice, and documentation included.
13. Prevention Counterfeiting
13.1 Farmaxx at all times only offers products that it purchases from the original manufacturers and their wholesalers. In case of doubt about the authenticity of products, the Buyer can find more information and tips on the website https://www.eccbelgie.be. In case of suspicion of counterfeiting, the consumer can always submit a complaint via the Meldpunt https://meldpunt.belgie.be/meldpunt.
14. Force of the majority
14.1 In case of force majeure, Farmaxx is not obliged to fulfill its obligations towards the other party. Farmaxx is entitled to suspend its obligations for the duration of the force majeure.
14.2 Force majeure is understood to mean any circumstance beyond its control that prevents the fulfillment of its obligations towards the other party in whole or in part.
14.3 In case of Force Majeure:
- Farmaxx will inform the Buyer of this, and;
- Farmaxx's obligations under the Agreement will be suspended and the term for the performance of the obligations will be extended for the duration of the Force Majeure situation. When the Force Majeure situation affects the delivery of the Products, Farmaxx will arrange a new delivery date with the Buyer after the Force Majeure situation has passed.
15. Intellectual ownership
15.1 All intellectual property rights and derivative rights are retained with Farmaxx .
15.2 These intellectual property rights are understood to mean copyrights, trademarks, drawings and design rights, intellectual property on software and / or other (intellectual property ) rights, including patentable or non-patentable technical and / or commercial know - how , methods and concepts.
15.3 The Buyer is prohibited from making use of and / or making changes to the intellectual property rights as described in this article, unless it is purely for private use of the product itself. URLs that are included on the website or other electronic communication portals , which are under the actual control of Farmaxx , can be clicked on and visited by the Buyer entirely under his own responsibility.
16. Processing personal data
16.1 The information provided by the Buyer is necessary for the processing and completion of the orders, and the preparation of the invoices and warranty contracts.
If this information is missing, the order will inevitably be canceled.
Providing incorrect or false personal data is considered a violation of the current General Terms and Conditions. The personal data of the Buyer shall only be processed in accordance with the applicable privacy statement can be consulted via the Farmaxx-website.
17. Miscellaneous
17.1 Farmaxx can change these general terms and conditions at any time. The general terms and conditions in force at the time of the order of the Products will apply to the Agreement between the Buyer and Farmaxx.
17.2 Without prejudice to the rights and remedies granted to Buyer by applicable law or these terms and conditions , our liability for direct damage will be limited to the value of the Products ordered.
17.3 The nullity of any provision or part of a provision under the Agreement will in no way affect the validity of the remainder of the provision or the remainder of the provisions and clauses.
17.4 Farmaxx always handles the personal data of its customers carefully, which is processed and stored in a secure manner. 18. Applicable law and competent court
18.1 Only Belgian law applies to all offers and agreements. The applicability of the Vienna Sales Convention is explicitly excluded.
18.2 All disputes related to or arising from offers from Farmaxx, or agreements concluded with it, will be submitted to the competent territorial court, unless a mandatory legal provision explicitly designates another court as competent.
